Know Your Rights: A Parent’s Guide to Surviving Alabama DHR

If DHR has knocked on your door, you are not alone and you still have rights. This guide was created to help Alabama families understand the truth, stand firm, and survive the storm. Whether you are facing an investigation, trying to stop a removal, or just want to be prepared, this guide is for you.

Before They Come — Prevention and Preparedness

  • Keep a DHR Survival Folder with birth certificates, school records, medical records, and any communication you have had with DHR.
  • Document parenting decisions, discipline approaches, and any concerns with school or medical providers.
  • Talk to an attorney in advance if there is any risk of a report being made. Early legal advice can make a difference.

When DHR Shows Up

  • You are not legally required to let DHR into your home unless they have a warrant or court order.
  • You have the right to remain silent. Anything you say can be misinterpreted or used against you.
  • You can and should record all interactions if legally permitted in your area. In Alabama, one-party consent allows you to record your own conversations.

Your Legal Rights During an Investigation

  • You have the right to an attorney. If you cannot afford one, ask the court to appoint counsel.
  • You are not required to submit to drug tests or psychological evaluations without a court order.
  • You can request copies of any reports or findings made about you.

After Removal — What You Are Entitled To

  • You have the right to an emergency hearing. In Alabama, this typically occurs within 72 hours of a removal.
  • You have the right to attend all hearings, present your side of the story, and challenge any evidence.
  • You can file appeals, motions, or complaints if your rights are violated. Do not wait — time matters in these cases.

Common Tactics and How to Push Back

  • Do not sign a safety plan under pressure. These documents are often used against you in court.
  • If you are threatened with removal for not signing, document the threat and request legal representation immediately.
  • Challenge “indicated” findings. They can follow you for years and impact future investigations or custody decisions.

  • Build your support team: legal counsel, a faith leader, a documentation partner, and a community of advocates.
