They say they just want to ask a few questions. They say there was a call. They say it’s routine.

But here’s the truth: you do not have to let them in.

Unless they have a signed warrant or court order, DHR has no legal right to enter your home.


Step 1: Stay Calm, Don’t Panic

Their presence can feel intimidating—and that’s the point. But remember, you have rights. You are not obligated to open the door or answer questions without legal representation.

  • Speak through the door or crack it slightly.
  • Keep your phone nearby to record (if legal in your state).

Step 2: Ask to See a Warrant or Court Order

You have the right to say:

“Do you have a warrant signed by a judge?”

If they do not have one, you can say:

“I do not consent to any entry or questioning without a court order. Please leave your contact information, and my attorney will follow up.”

Do not let them pressure you into a “home walkthrough” or quick chat. Anything you say or show can and will be used to build a case against you.


Step 3: Do NOT Sign Anything on the Spot

Sometimes they will present safety plans or forms and say, “This will help keep your children safe” or “You’ll look cooperative.”

Do not sign anything without reading it fully, understanding the implications, and speaking to a lawyer.


Step 4: Document the Visit

  • Write down names, badge numbers, and the exact time/date of the visit.
  • Record the interaction if allowed in your state (Alabama is a one-party consent state).
  • Take note of anything they say, even casually.

This protects you later if false statements are made in reports.


Step 5: Contact a Family Defense Attorney Immediately

Even if nothing happened during the visit, DHR may still be building a case. Get ahead of it:

  • Explain what happened.
  • Provide your notes and recordings.
  • Ask what to expect and how to prepare.

Free or low-cost legal aid may be available depending on your income.

DHR often relies on fear, surprise, and ignorance to get inside your home. But you are not powerless.
