Know Your Rights #8: You Have the Right to Challenge Unsafe or Inappropriate Placements

When a child is removed from a parent’s custody, the trauma doesn’t end with the removal. It continues through every placement, every transition, and every unsafe or unfit environment they are forced to endure. What many parents don’t realize is you have the right to challenge a placement decision if you believe it’s unsafe, inappropriate, or not in the best interest of your child.

The Law Is On Your Side

Alabama DHR policy and family law recognize that children should be placed in the least restrictive, most family-like setting available. This means the first consideration should always be kinship care—placement with a relative or close family friend—not strangers in foster care or group facilities.

If DHR bypasses this option or places your child in a situation that is questionable, you have legal recourse. You can object, request a review hearing, and demand that your concerns be officially documented in the court record.

You Are Allowed to Speak Up

Too often, parents are told to be quiet, cooperate, and wait. But silence can lead to tragedy. You are legally allowed to raise concerns about placement decisions. This includes:

Filing a formal objection in court Requesting a change in placement Submitting documentation or testimony about unsafe conditions Presenting suitable alternative caregivers (family or trusted friends)

You are not being difficult—you are protecting your child.

The Burden Is On Them

The system must justify any placement with clear and convincing evidence that it is in your child’s best interest. If you’ve offered a safer or more appropriate home, they cannot ignore that without a legal basis. You have the right to force that discussion, and to request your concerns be heard in court.
