When DHR labels your case as “indicated” for abuse or neglect, it can feel like the world is crashing in.
But indicated does not mean guilty—and you have the right to fight it.
One of the most important tools at your disposal is the Indicated Hearing, also known as the Child Abuse/Neglect Investigative Hearing.
This guide walks you through how to request it, how to prepare, and what to expect.
Step 1: Know Your Timeline
You only have 10 DHR working days from the date you receive the notice to request a hearing.
Act fast. Missing this window could result in that “indicated” finding staying on your record permanently, which can affect employment, custody, and more.
Step 2: Submit a Written Hearing Request
Write a formal letter requesting the hearing. Include:
- Your full name and contact information
- The child’s name
- The date of the indicated notice
- A statement clearly requesting an investigative hearing to contest the findings
Mail it certified and/or email it so you have a timestamped record.
Step 3: Gather Your Evidence
Treat this hearing like a courtroom. Come prepared.
What to gather:
- Communication logs with DHR
- Witness statements or letters of support
- Medical, school, and therapy records
- Audio or video recordings (if applicable)
- Any relevant documents that prove you provided proper care or disprove their claims
Organize it into a folder or binder—your Survival Folder comes in handy here.
Step 4: Consult with an Attorney (if possible)
If you can afford legal help, reach out to a family law or civil rights attorney ASAP. If not, you can:
- Contact Legal Services Alabama
- Ask the court if a pro bono attorney is available
- Seek help from advocacy groups or legal aid clinics
Even without a lawyer, you still have the right to defend yourself.
Step 5: Prepare to Speak and Present
At the hearing, you’ll be able to:
- Cross-examine DHR’s findings
- Present your own evidence
- Call witnesses
- Tell your side of the story
Stay calm. Be respectful. Let the facts speak.
Final Thoughts:
DHR’s word isn’t final—unless you let it be.
Use your hearing. Use your voice. Use your truth.
Because once that label sticks, it can change everything. But if you fight back in time, you give your family a fighting chance.
