If you’re dealing with DHR in Alabama, don’t let fear or confusion silence you. You have rights — and the more you know, the harder it is for the system to take advantage of you.

Here are 5 rights DHR hopes you’ll never discover:


1. You have the right to an attorney — even in investigations.

If DHR is investigating you, you do not have to face them alone. You can (and should) ask for legal representation early. In most cases, the court will appoint one if you can’t afford it.


2. They cannot remove your child without due process — unless it’s an emergency.

DHR must have a court order to remove your child, unless they can prove it’s an immediate emergency. You still have a right to a hearing very quickly afterward — don’t let delays go unchecked.


3. You have the right to speak in court and present your side.

You can challenge evidence, bring witnesses, and request documentation. Don’t let them act like your presence is optional — it’s your constitutional right.


4. You have the right to request kinship placement.

If your child is removed, you can and should request that they be placed with family first. DHR often ignores this unless you speak up — and speak clearly.


5. You have the right to access your case file.

You can request copies of all reports and records tied to your case. That includes what they’re using against you. Don’t fight blind — get the paperwork.
